ForeverBook provides a personalization platform for creating custom children’s books, stories, illustrations, digital books, printed books, keepsakes, subscriptions, and related creative products.

ForeverBook combines advanced creative technologies with human-designed storytelling frameworks to help customers create personalized stories featuring children, family members, friends, pets, and other approved characters.

ForeverBook may offer:

• personalized digital books
• printed softcover books
• printed hardcover books
• printed premium layflat books
• subscription-based story products
• story credits
• digital downloads
• gift add-ons
• physical keepsake products
• related digital or printed products

ForeverBook is a creative storytelling and publishing platform. Each book is unique and created from the information, selections, prompts, and personalization details provided by the user.

2. Eligibility and Family Use

ForeverBook is intended for family-friendly creative use.

By using the Service, you confirm that you have permission to provide information, images, names, details, or personalization information for any child, family member, pet, or other person included in a ForeverBook story.

If you are under the age required to form a binding contract in your jurisdiction, you may use the Service only with permission from a parent or legal guardian.

By completing a purchase, you confirm that you are authorized to use the payment method provided and agree to these Terms and our Privacy Policy.

3. Accounts and User Information

Some features of the Service may require you to create an account. You agree to provide accurate, current, and complete information when creating an account or placing an order.

You are responsible for:

• all activity that occurs under your account
• ensuring that any information submitted is accurate and appropriate

ForeverBook is not responsible for delays, errors, failed deliveries, or content issues caused by inaccurate information submitted by users.

4. User Content and Personalization Information

"User Content" means any information, text, names, images, descriptions, prompts, preferences, traits, interests, dedications, personalization details, character details, pet details, uploaded materials, or other content you provide to ForeverBook.

You are solely responsible for the User Content you submit.

By submitting User Content, you confirm that:

• you have the right or permission to provide it
• it does not violate another person’s privacy rights
• it does not infringe intellectual property rights
• it is not unlawful, abusive, hateful, obscene, threatening, defamatory, or otherwise inappropriate
• it does not contain confidential information you are not authorized to share

ForeverBook reserves the right to reject, remove, moderate, edit, or refuse to create content based on User Content that we believe violates these Terms, our policies, applicable law, or the intended family-friendly nature of the Service.

ForeverBook does not acquire ownership of personal User Content submitted by users.

5. Permission to Use User Content

By submitting User Content to ForeverBook, you grant ForeverBook a limited, worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, process, display, store, and create derivative works from that User Content solely as needed to:

• provide the Service
• create personalized stories and illustrations
• generate book previews
• produce digital downloads
• print and fulfill physical products
• improve quality and consistency
• provide customer support
• operate, maintain, and improve the platform

ForeverBook does not claim ownership of your personal User Content. However, you understand that the personalized stories, illustrations, and creative outputs generated through the Service may incorporate or be based on the User Content you provide.

6. Creative Generation and Artistic Variations

ForeverBook uses advanced creative technologies, storytelling systems, image-generation tools, editing tools, and quality review processes to create personalized books.

Because each book is individually generated and customized, minor artistic variations may naturally occur throughout a story. These may include small differences in:

• illustration details
• character appearance
• facial expressions
• lighting
• backgrounds
• clothing details
• artistic interpretation
• layout
• colors
• scene composition
• or visual consistency between pages

These small variations are a normal part of personalized creative generation and help make each ForeverBook unique.

ForeverBook works to provide a high-quality experience and continues to improve its systems over time. However, you understand that personalized creative outputs may not be perfectly identical from page to page or from book to book.

7. Customer Review and Approval

ForeverBook provides customers with the ability to review, edit, and approve personalized stories and illustrations before final purchase, digital delivery, or physical production.

By completing checkout and approving a book for purchase, you acknowledge that:

• you have reviewed the book to your satisfaction
• personalization details are accurate to the best of your knowledge
• spelling, names, dedications, and character details have been reviewed
• the book is approved for final production and/or digital delivery

ForeverBook is not responsible for:

• customer-entered spelling errors
• incorrect names or dates
• incorrect personalization details
• inaccurate character or pet descriptions
• creative choices approved during the review process
• minor artistic variations that are part of the creative generation process

You are encouraged to carefully review all book content before completing your purchase.

8. Quality Review and Enhancements

To help maintain the quality and consistency of the ForeverBook experience, ForeverBook reserves the right to review, adjust, correct, enhance, or improve stories and illustrations before or after purchase when necessary.

These adjustments may include:

• correcting technical or formatting issues
• improving illustration consistency
• fixing spelling or generation errors
• enhancing print quality
• improving layout or readability
• correcting obvious visual issues
• making minor creative refinements that improve the overall customer experience

ForeverBook will make reasonable efforts to preserve the original intent, tone, and personalization of each story.

This quality review process is intended to improve the final product and customer experience. It does not guarantee that every book will be manually reviewed or adjusted.

9. Personalized Products, Returns, and Refunds

Because every ForeverBook is custom-created and personalized specifically for each customer, all sales are generally final once printing, digital delivery, or custom production has begun.

Due to the personalized nature of our products, ForeverBook does not accept returns or exchanges for:

• personalized books
• custom stories
• custom illustrations
• digital downloads
• printed keepsake books
• subscription-generated books
• story credits
• custom gift products
• personalized add-ons

Customers are responsible for reviewing and approving their books before purchase.

10. Damaged, Defective, or Incorrect Orders

If your physical order arrives damaged, defective, or materially different from what was approved during checkout, please contact us at support@foreverbookshop.com within 7 days of delivery.

ForeverBook may request photos or additional information to review the issue.

If ForeverBook determines that an order was damaged, defective, or materially incorrect due to production or fulfillment error, ForeverBook may, at its discretion:

• provide a replacement
• issue store credit
• correct and reprint the product
• or offer another reasonable resolution

ForeverBook does not guarantee refunds or replacements for issues caused by customer-entered errors, approved creative choices, shipping carrier delays, minor artistic variations, or normal differences in print appearance.

11. Digital Products and Downloads

ForeverBook may offer digital books, downloadable files, PDF files, EPUB files, previews, digital editions, or other electronic content.

Digital downloads are licensed, not sold, and are intended solely for personal, family, and non-commercial use.

Because digital products may be delivered immediately, digital purchases are non-refundable once access has been provided.

You may not:

• resell digital products
• redistribute digital files publicly
• upload files to public sharing platforms
• use digital products commercially
• remove watermarks or ownership markings
• reproduce ForeverBook content for commercial purposes
• create competing products using ForeverBook outputs

ForeverBook may limit, revoke, or modify access to digital products if we believe the Service is being misused.

12. Printed Products and Fulfillment

ForeverBook partners with professional printing and fulfillment providers to produce and ship physical books and related products.

Estimated production and shipping times are estimates only and are not guaranteed unless expressly stated.

ForeverBook is not responsible for delays caused by:

• shipping carriers
• incorrect addresses
• weather events
• production delays
• supply issues
• customs or delivery restrictions
• customer failure to provide required information

Customers are responsible for ensuring that shipping information is accurate before completing an order.

13. Subscriptions

ForeverBook may offer recurring subscription plans that allow customers to receive personalized books at selected intervals, including annual, quarterly, monthly, or other plans.

By purchasing a subscription, you authorize ForeverBook to charge your selected payment method according to the subscription terms presented at checkout.

Subscription terms may include:

• recurring billing
• scheduled book creation windows
• reminders to update recipient details
• recurring delivery intervals
• optional upgrades
• shipping charges
• add-on charges
• digital or physical product options

You are responsible for keeping payment, billing, recipient, and shipping information up to date.

Customers may manage, pause, or cancel subscriptions through their account settings or by contacting ForeverBook support, subject to the terms presented at checkout.

Cancellation will apply to future billing cycles and does not automatically cancel or refund orders already in production, already generated, already delivered, or already billed.

14. Subscription Reminders and Customer Updates

For subscription products, ForeverBook may send reminders by email, text message, or other communication channels to request updated details before the next book is created.

If updated information is not provided by the requested deadline, ForeverBook may:

• use existing recipient information
• delay book creation
• pause fulfillment
• create a book based on previously provided details
• or contact the customer for additional information

ForeverBook is not responsible for missed deadlines, delayed deliveries, or outdated personalization caused by customer failure to respond to reminders or update recipient information.

15. Story Credits

ForeverBook may offer promotional, purchased, subscription-based, complimentary, or account-based Story Credits used to create personalized books or other creative content.

Unless otherwise stated, Story Credits:

• may be used only within the ForeverBook platform
• are non-transferable
• have no cash value
• are not redeemable for cash
• may not be resold
• may be subject to usage limits, expiration rules, or promotional restrictions

ForeverBook may modify Story Credit pricing, availability, usage rules, or expiration policies at any time, subject to applicable law.

ForeverBook may revoke credits if we believe they were obtained through fraud, abuse, promotional misuse, or violation of these Terms.

16. Free Book Generation and Usage Limits

ForeverBook may allow users to generate a limited number of free books, previews, or creative projects.

ForeverBook reserves the right to limit, modify, suspend, or discontinue free generation limits at any time.

Free generation limits may be based on:

• account activity
• number of generated books
• promotional status
• subscription status
• purchase history
• abuse prevention
• platform costs
• or other business or technical factors

ForeverBook may require the purchase of Story Credits, a digital product, a printed product, or a subscription in order to continue generating additional books.

Unless otherwise stated, editing or reviewing already-generated books does not automatically create a right to unlimited new book generation.

17. Promotional Offers, Discounts, and Beta Programs

ForeverBook may offer promotional pricing, beta programs, founding user offers, free books, discounts, trial offers, referral rewards, or other special promotions.

Promotional offers may be subject to additional terms, limitations, eligibility rules, expiration dates, or usage restrictions.

ForeverBook reserves the right to modify, revoke, or discontinue promotions at any time.

Participation in beta or founding user programs may require feedback, surveys, or other participation requirements in order to receive promotional benefits.

18. Payments and Billing

Payments are processed through third-party payment processors, such as Stripe or other providers.

By providing payment information, you represent that you are authorized to use the payment method provided.

You agree to pay all charges, taxes, shipping fees, subscription fees, upgrade fees, digital product fees, add-on fees, and other amounts shown at checkout.

ForeverBook is not responsible for payment processing errors caused by third-party payment providers, banks, card issuers, or inaccurate customer billing information.

19. Taxes, Shipping, and Additional Charges

Prices shown on the Service may not include taxes, shipping, handling, duties, or other charges unless expressly stated.

Applicable taxes, shipping fees, upgrade fees, and add-on charges may be calculated and displayed during checkout.

Customers are responsible for all applicable charges associated with their orders.

20. Intellectual Property and Platform Ownership

ForeverBook and its licensors retain all rights, title, and interest in and to the ForeverBook platform, website, software, creative systems, story frameworks, prompts, templates, workflows, interfaces, branding, designs, illustrations, generation systems, editing systems, technology, and all related intellectual property and proprietary materials associated with the Service.

This includes, without limitation:

• copy,
• reproduce,
• reverse engineer,
• scrape,
• redistribute,
• commercially exploit,
• sublicense,
• modify,
• use ForeverBook content or outputs to train artificial intelligence models or machine learning systems,
• train competing systems using ForeverBook content or outputs,
• or create derivative commercial products from the ForeverBook platform or related systems.

These materials are protected by intellectual property, copyright, trademark, and other applicable laws.

Except as expressly permitted in these Terms, users may not:

• copy,
• reproduce,
• reverse engineer,
• scrape,
• redistribute,
• commercially exploit,
• sublicense,
• modify,
• train competing systems using,
• or create derivative commercial products from the ForeverBook platform or related systems.

No ownership rights to the ForeverBook platform or underlying creative systems are transferred to users through use of the Service.

21. Ownership and Personal Use of Purchased Books

Users retain personal-use rights to the personalized books they create through ForeverBook, including purchased printed books and purchased digital downloads for personal, family, gifting, and non-commercial use.

You may:

• read and enjoy the book personally
• gift physical copies to friends or family
• privately share the book with family members
• store and view purchased digital editions for personal use
• print additional personal copies for private use or gifting purposes

However, books and digital downloads created through ForeverBook may not be:

• commercially reproduced,
• resold,
• redistributed publicly,
• sublicensed,
• commercially published,
• used for advertising or promotional resale purposes,
• incorporated into competing products or services,
• used to train artificial intelligence systems,
• or otherwise commercially exploited without prior written permission from ForeverBook.

ForeverBook retains ownership of the ForeverBook platform, generation systems, creative workflows, templates, illustration pipelines, story systems, and all underlying intellectual property used to create the books and user experience.

Nothing in these Terms transfers ownership of the ForeverBook platform or creative generation systems to users.

22. Acceptable Use

You agree not to use the Service to create, submit, upload, generate, or distribute content that:

• is unlawful, harmful, abusive, hateful, obscene, defamatory, threatening, or violent
• exploits or harms children
• invades another person’s privacy
• infringes copyrights, trademarks, or other rights
• impersonates another person without permission
• contains sexually explicit material involving minors
• promotes self-harm or violence
• includes malicious code or attempts to disrupt the Service
• attempts to bypass security, moderation, payment, or generation limits
• uses automated scraping, bots, or abuse patterns
• violates applicable law

ForeverBook may suspend or terminate accounts that violate this section.

23. Content Moderation and Refusal of Service

ForeverBook reserves the right to review, moderate, refuse, remove, or decline to generate content at our discretion.

We may refuse service, cancel orders, suspend accounts, or remove content if we believe a user has violated these Terms, submitted inappropriate content, misused the Service, engaged in fraud, or created risk for ForeverBook, other users, children, or third parties.

24. Privacy and Children’s Information

Your use of ForeverBook is also governed by our Privacy Policy.

Because ForeverBook may involve personalization details about children, users must have appropriate permission to submit such information.

ForeverBook is intended to be used by adults, parents, guardians, family members, gift-givers, or other users who have permission to provide personalization details for a child.

ForeverBook does not knowingly collect personal information directly from children under 13 without appropriate consent where required by law.

25. Email and Text Communications

By creating an account, placing an order, subscribing, or contacting ForeverBook, you may receive transactional emails related to your account, order, subscription, digital delivery, support requests, reminders, or product status.

If you opt in to marketing emails or text messages, you may receive promotional messages, updates, offers, product announcements, or related communications.

You may unsubscribe from marketing emails or opt out of marketing text messages as described in those communications. Transactional messages related to orders, subscriptions, billing, or account activity may still be sent as needed.

ForeverBook may rely on third-party services for payment processing, hosting, email delivery, printing, shipping, analytics, image processing, creative generation, customer support, and other operational needs.

ForeverBook is not responsible for third-party service outages, delays, errors, terms, privacy practices, or failures.

Use of third-party services may be subject to those providers’ separate terms and policies.

27. Service Availability and Changes

ForeverBook may modify, update, suspend, discontinue, or change any part of the Service at any time.

We do not guarantee uninterrupted access to the Service.

ForeverBook may update features, pricing, product options, creative tools, subscriptions, generation systems, book formats, add-ons, or policies as the platform evolves.

28. No Guarantee of Specific Results

ForeverBook aims to create high-quality personalized stories and illustrations, but we do not guarantee that every output will meet every subjective expectation.

Creative results may vary based on:

• user-provided information
• selected story preferences
• character details
• pet details
• creative generation systems
• editing choices
• image quality
• product format
• and other factors

Users are responsible for reviewing and approving their books before completing purchase.

29. Disclaimers

The Service and products are provided on an "as is" and "as available" basis to the maximum extent permitted by law.

ForeverBook disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement, except where prohibited by law.

ForeverBook does not warrant that the Service will be uninterrupted, error-free, secure, or free of defects.

Some jurisdictions do not allow certain disclaimers, so some of these limitations may not apply to you.

30. Limitation of Liability

To the maximum extent permitted by law, ForeverBook shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Service or products.

ForeverBook’s total liability for any claim relating to the Service, products, subscriptions, digital downloads, or orders shall not exceed the amount you paid to ForeverBook for the specific order or service giving rise to the claim.

You may stop using the Service at any time.

Termination does not affect obligations that arose before termination, including payment obligations, intellectual property rights, disclaimers, limitations of liability, and indemnification obligations.

When we update the Terms, we will revise the "Last Updated" date above.

Your continued use of the Service after updated Terms are posted means you accept the updated Terms.

These Terms shall be governed by the laws of the State of Oregon, without regard to conflict of law principles.

Any disputes shall be resolved in the courts located in Hood River County Oregon, unless otherwise required by applicable law.
